One of the most common crimes happening in Australia is about drug offenses and if one looks at the last ten years, drug crime is the most common reason among new prisoners in our prisons.
Is this a kind of proof that our Australia population turns into depraved drug addicts or is it proof that the police are more efficient and have found better ways to curb drug crimes?
A combination, we would like to say. Of course, we do not mean that this is a wave of drug addicts in this – we rather mean that one must make a difference between different drugs and how they are perceived by different people.
Just take such a drug as marijuana and put a joint in front of two people and see what reaction you are faced with. One should perhaps kick back, call the police and say that one flare would lead to a life of social misery – this while the other would happily take the joint, pick up a lighter and start smoking.
Exaggerated of course – but the latter has here de facto committed a drug crime and is at risk of being punished for this.
Drug offenses are thus something that must be assessed a little differently as to what drug it is about, in what quantity and on whether it is intended for sale further or if it is available for own use.
We may find that there is a bit of rigid assessment in many cases and where a drug crime like the one we mentioned above might pass – without us in any way propagating for marijuana, but where we are more trying to nuance the picture and explain the difference between different drug offenses.
Suspicious – A skilled lawyer gives you an advantage
We can say here that you are the one who smoked the joint above and that there was a police nearby who saw the whole process. Here you will risk being sentenced for a drug offense and it will probably end with a fine.
We are playing with the idea that here at a search at home with you you have found very much more marijuana and that with this new find you risk a higher punishment where prison is not excluded – how should you act here?
Well, our advice is that you hire a lawyer and that you choose one that has an obvious experience of drug offenses. You should not, therefore, trust that the attorney you are assigned will give you just as good help and this is something many people can sign up for.
We must be sentenced just before the law – but the fact is that when it comes to drug offenses, various factors – origin, neighborhood one comes from, age, sex and profession – play a certain role and therefore an experienced representative is always something that can give a lower penalty – no matter where on the scale you are.
